Who Owns The Roads: City Council Tasks Attorney

After being in office for over a year, the members of the Sandy Oaks City Council admitted on August 13, 2015 that they still don’t know who owns the roads.

Mayor Pro Tempore Earnest Gay introduced the topic at the August 13th City Council meeting.

There’s always been some contention as to whether certain streets belong to the city, certain streets belong to the WPPOA.  If they do belong to the WPPOA are they required to maintain them?  Are we required to maintain them?  We need to know exactly what that is and where we stand on that.  And I don’t know how you would do that.

Alderman David Tremblay brought up the community of Alamo Ranch, an unincorporated area, and said their POA raised enough money to maintain their community’s roads.  He said

That tends to enforce the thought that we have that there are streets within the city that are not the city’s responsibility at this time.

Tremblay added that if the city accepted the properties from the WPPOA that the city would be accepting the streets as well.

The Council decided unanimously to have the new City Attorney find who was responsible for the roads.  Mayor Pro Tempore Earnest Gay made the motion and Alderman Micki Ball seconded it.

City Attorney Leslie Kassahn said she would provide a general summary of what the state law is and what responsibilities the city had for the streets.  She also said she would do a search on the Bexar County website to see who owned the streets.
